LEELTHERAPY
CLIENT TERMS, INFORMED CONSENT & PRIVACY NOTICE

These Terms apply to services provided by LEELTHERAPY, operated by Erika Lencsés, to clients internationally, including clients in South Africa, Europe, the United Kingdom, the United States and Canada.

Nothing in these Terms is intended to exclude or limit any mandatory consumer, privacy or other legal rights that apply to you under the laws of your country or place of residence.

1. THE SERVICES I PROVIDE

LEELTHERAPY provides Rapid Transformational Therapy® (RTT®) and hypnotherapy to support clients with emotional, behavioural and personal-development concerns.

RTT® is the primary therapeutic approach used in my practice and incorporates hypnosis/hypnotherapy as part of the therapeutic process.

Sessions may take place online or in person.

The services are intended to support personal change and wellbeing. They are not a substitute for medical diagnosis, medical treatment, psychiatric care, psychological care or emergency services.

2. INFORMED CONSENT

By booking and participating in a session, you confirm that you understand the nature of RTT® and hypnotherapy and voluntarily choose to participate.

Hypnosis involves a state of focused attention and relaxation. You remain aware of what is happening and communicate with me throughout the session.

You remain in control and may ask to pause or stop the session at any time.

3. WHAT THE THERAPEUTIC PROCESS MAY INVOLVE

During a session, we may explore thoughts, emotions, beliefs, behaviours, experiences and patterns that may be connected to the difficulties you are currently experiencing.

Depending on your individual circumstances, the process involves exploring earlier experiences and memories.

The purpose is to help you understand how these experiences may relate to your present experience and support constructive change.

4. MEMORIES AND REGRESSION

During therapeutic work, you may experience memories, images, emotions, sensations or thoughts relating to earlier periods of your life.

It is important to understand that memory is not a perfect recording of the past.

A memory, image or experience arising during hypnosis or therapeutic work may be incomplete, altered, reconstructed or symbolic.

You therefore agree not to treat memories arising during a session as automatically being historically accurate or as proof that a particular event occurred.

I will not encourage you to regard a memory arising during therapy as factual evidence against another person.

The purpose of this work is to understand your present experience and support positive change.

5. YOUR RESPONSIBILITY

Therapy is a collaborative process.

I will provide professional guidance and support, but I cannot guarantee a particular result or outcome.

Your progress may depend on many factors, including your circumstances, participation in the process and your willingness to engage with recommended practices between sessions.

Where a personalised transformational recording is provided, you are encouraged to listen to it regularly for approximately 21–28 days.

You are responsible for listening to your recording only when you are in a safe environment and are not driving, operating machinery or carrying out an activity requiring your full attention.

6. NO GUARANTEE OF RESULTS

Every person responds differently to therapeutic work.

Some clients may experience significant changes relatively quickly, while others may require additional sessions or other forms of support.

No particular number of sessions, result or timeframe can be guaranteed.

Testimonials and examples of client experiences represent individual experiences only and are not a promise that you will experience the same results.

7. MEDICAL AND MENTAL HEALTH DISCLAIMER

LEELTHERAPY does not provide emergency medical or psychiatric services.

RTT® and hypnotherapy do not replace diagnosis, treatment or advice from a qualified doctor, psychiatrist, psychologist or other appropriately qualified healthcare professional.

You should continue any prescribed medical or mental-health treatment unless your own healthcare professional advises otherwise.

Do not stop, reduce or change medication because of anything discussed during a LEELTHERAPY session.

If I believe that another form of professional care would be more appropriate for you, I may recommend that you seek support from an appropriately qualified healthcare professional.

8. SUITABILITY AND EXCLUSIONS

For safety reasons, LEELTHERAPY does not provide RTT® or hypnotherapy to individuals with certain medical, neurological or psychiatric conditions.

· This includes, but is not limited to:
Epilepsy or a history of seizures

· Schizophrenia or other psychotic disorders

· Bipolar disorder where there is a history of mania or hypomania

· Severe dissociative disorders

· Other conditions where hypnosis, or the therapeutic process may be inappropriate or unsafe

If you have any of these conditions, you are not eligible to participate in RTT® or hypnotherapy with LEELTHERAPY.

You are responsible for informing me accurately and honestly about any relevant medical, neurological or mental-health condition before booking or participating in a session.

LEELTHERAPY reserves the right to decline or discontinue a session if I believe that the service is not appropriate or safe for you.

RTT® and hypnotherapy are not emergency, psychiatric or medical services and should not be used as a substitute for appropriate medical or mental-health care.

9. EMERGENCIES

LEELTHERAPY is not an emergency or crisis service.

If you are experiencing an immediate medical or psychological emergency, are at risk of harming yourself or another person, or require urgent assistance, you should contact the appropriate emergency service or healthcare professional in your country.

10. ONLINE SESSIONS

· For online sessions, you are responsible for having:
A private and suitable environment

· A reliable internet connection

· A functioning device and audio connection

· Sufficient battery or power

· An environment where you will not be interrupted

You must not participate in a session while driving, operating machinery or doing anything requiring your full attention.

I may postpone or end an online session if the environment or connection is unsuitable.

11. APPOINTMENTS

Please attend your appointment on time.

If you arrive late, the session may still need to finish at the originally scheduled time.

If lateness significantly reduces the time available or makes the session unsuitable, the appointment may be treated as a late cancellation.

12. CANCELLATION AND RESCHEDULING

Please provide at least 48 hours' notice if you need to cancel or reschedule an appointment.

Where less than 48 hours' notice is given, or where you do not attend, the session will be non-refundable and charged in full.

I may waive a cancellation charge in exceptional circumstances at my discretion.

Nothing in this section removes or restricts any mandatory consumer cancellation or refund rights that apply to you under the law of your country.

13. EU AND UK DISTANCE CONTRACTS

Where applicable law gives you a statutory right to cancel a service purchased online or at a distance, that right will apply.

For EU and UK consumers, this may include a 14-day cancellation period for certain distance contracts.

If you expressly request that services begin during the applicable cancellation period, you may be required to pay for services already provided if you subsequently cancel.

Where a service has been fully performed following your express request and acknowledgement, your statutory right to cancel may end where permitted by applicable law.

Any mandatory consumer rights applicable to you take precedence over these Terms.

14. FEES AND PAYMENT

Programme and session fees are payable according to the price and payment arrangement agreed at the time of booking.

Where an instalment plan has been agreed, each instalment remains payable according to the agreed payment schedule.

Payment for a programme does not guarantee a particular therapeutic outcome.

Any refund will be handled in accordance with these Terms and any mandatory consumer rights applicable to you.

15. PERSONALISED TRANSFORMATIONAL RECORDINGS

Where your programme includes a personalised transformational recording, the recording is created specifically for your individual use.

· It must not be:
Shared with another person

· Publicly uploaded

· Commercially distributed

· Reproduced for commercial purposes

· Modified and represented as the work of another person

You should listen to the recording only when you are somewhere safe and are not driving or performing another activity requiring your full attention.

16. CONFIDENTIALITY

Information shared during your sessions will be treated as confidential, subject to applicable law and the exceptions described in these Terms and the Privacy Notice.

· Confidentiality may be limited where:
Disclosure is required by law or court order

· Disclosure is necessary to protect you or another person from serious and immediate harm

· Disclosure is otherwise legally required or permitted

· Disclosure is necessary for professional supervision, provided reasonable steps are taken to protect your identity

17. PROFESSIONAL BOUNDARIES

Communication outside scheduled sessions should generally be limited to practical matters such as appointments, programme administration and brief communication relating to your agreed work.

Email, WhatsApp and other messaging services are not emergency or crisis services.

18. INTELLECTUAL PROPERTY

All materials created by LEELTHERAPY, including recordings, written materials, scripts, exercises and other resources, remain the intellectual property of LEELTHERAPY unless otherwise agreed in writing.

Materials provided to you are for your personal use and may not be copied, reproduced, published, sold or commercially distributed without written permission.

19. AGE AND CAPACITY TO CONSENT

You confirm that you are at least 18 years of age, or the age of majority in your place of residence if higher, and that you have the legal capacity to enter into this agreement.

LEELTHERAPY does not knowingly provide RTT® or hypnotherapy services to a person under the age of majority in their jurisdiction without the prior written consent of a parent or legal guardian, where such participation is otherwise permitted by law.

If you are participating on behalf of, or with the involvement of, a minor where locally permitted, the consenting parent or legal guardian accepts these Terms on that minor's behalf and takes responsibility for their wellbeing outside of sessions.

You confirm that you are not participating in a session while under the influence of alcohol or non-prescribed drugs, and that you are not currently experiencing an acute mental-health crisis requiring emergency care.

20. ASSUMPTION OF RISK

You acknowledge that RTT® and hypnotherapy, like any therapeutic process that explores emotions, memories and beliefs, may bring up difficult emotions, temporary discomfort, fatigue or unexpected psychological responses, both during and after a session.

You voluntarily assume the risks inherent in this therapeutic process, on the understanding that such risks cannot be entirely eliminated and that individual responses to therapeutic work vary.

You confirm that the medical, psychiatric and neurological information you have disclosed under Section 8 is accurate and complete to the best of your knowledge, and that LEELTHERAPY is entitled to rely on that disclosure in assessing your suitability for the service.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, LEELTHERAPY, Erika Lencsés and any associated contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, income, opportunity or data, arising out of or relating to the services.

Except where such a limit is not permitted under applicable law, including mandatory consumer-protection law in your country of residence, LEELTHERAPY's total aggregate liability to you arising from or relating to the services will not exceed the total fees you paid for the specific programme or session giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the law of your country of residence.

These limitations apply regardless of the legal basis of the claim, whether in contract, tort (including negligence), statute or otherwise, and survive the end of the services.

22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless LEELTHERAPY and Erika Lencsés from third-party claims, losses, damages, liabilities and reasonable costs arising from: (a) your breach of these Terms; (b) inaccurate or incomplete information provided by you about your medical, psychiatric or neurological history; or (c) your unauthorised use, copying or distribution of any recording or material provided to you.

This indemnity does not apply to claims arising from LEELTHERAPY's own negligence, wilful misconduct or breach of applicable law, and does not affect any right you have under mandatory consumer-protection law that cannot lawfully be excluded.

23. ELECTRONIC AGREEMENT AND SIGNATURES

These Terms, the Privacy Notice and related consents may be accepted electronically, including by ticking a box, typing your name, or using an electronic-signature tool.

Where recognised under applicable law — including the U.S. ESIGN Act and UETA, the EU eIDAS Regulation, the UK's Electronic Communications Act 2000, Canada's PIPEDA and provincial electronic-commerce legislation, and South Africa's Electronic Communications and Transactions Act 25 of 2002 — your electronic acceptance has the same legal effect as a handwritten signature.

You consent to receive these Terms, invoices, appointment confirmations and related communications electronically.

24. FORCE MAJEURE

LEELTHERAPY will not be liable for delay or failure to perform any obligation caused by circumstances reasonably beyond its control, including internet, platform or power outages, illness, extreme weather, or government action.

Where a session cannot proceed because of such circumstances, LEELTHERAPY will offer to reschedule the session at no additional charge.

25. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles, except to the extent that mandatory consumer-protection law of your country of residence provides otherwise.

Before starting any formal proceedings, you and LEELTHERAPY agree to first try to resolve any dispute informally by contacting erika@leeltherapy.com.

Subject to the paragraph below, any dispute that cannot be resolved informally will be submitted to the courts of the Republic of South Africa having jurisdiction.

If you are a consumer, nothing in this section removes your right to bring proceedings in the courts of your own country of habitual residence, or deprives you of the protection of any mandatory provisions of the law of that country, including your right to use free or low-cost dispute-resolution schemes such as the EU Online Dispute Resolution platform, the UK's applicable ombudsman schemes, or equivalent consumer bodies in your country.

26. GENERAL PROVISIONS

· This section sets out additional terms that apply to our agreement:
Severability — if any provision of these Terms is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.

· Entire agreement — these Terms, the Privacy Notice, and any specific programme agreement constitute the entire agreement between you and LEELTHERAPY regarding the services, superseding prior discussions on the same subject.

· Amendments — LEELTHERAPY may update these Terms from time to time; the version in force at the time of your booking applies to that engagement, and material changes affecting an ongoing programme will be communicated to you.

· No waiver — a failure by LEELTHERAPY to enforce a provision is not a waiver of the right to enforce it later.

· Assignment — you may not assign your rights or obligations under these Terms without LEELTHERAPY's written consent; LEELTHERAPY may assign these Terms in connection with a transfer of its business.

· Language — these Terms are provided in English; where translated, the English version prevails to the extent permitted by law.

PRIVACY NOTICE

27. GDPR, POPIA AND INTERNATIONAL PRIVACY

· LEELTHERAPY respects and complies with applicable data-protection and privacy legislation, including:
The Protection of Personal Information Act 4 of 2013 (POPIA) in South Africa

· The General Data Protection Regulation (GDPR) where applicable

· Applicable UK data-protection legislation

· Applicable privacy and consumer-protection legislation in other jurisdictions in which LEELTHERAPY provides services

Nothing in this Privacy Notice removes or limits rights that cannot lawfully be excluded under applicable data-protection legislation.

28. WHO IS RESPONSIBLE FOR YOUR DATA?

For purposes of POPIA, LEELTHERAPY acts as the Responsible Party in respect of personal information processed for the purposes of providing its services.

Where GDPR applies, LEELTHERAPY acts as the Data Controller for personal data processed for these purposes.

Third-party service providers processing information on behalf of LEELTHERAPY may act as Operators under POPIA or Processors under GDPR, as applicable.

29. WHAT PERSONAL INFORMATION MAY I COLLECT?

· Depending on the services you use, I may collect:
Your name

· Age or date of birth where relevant

· Email address

· Telephone number

· Billing and payment information

· Appointment information

· Information provided in consultation or intake forms

· Information concerning your physical or mental health where relevant to the services

· Session notes

· Communications between us

· Information required to provide personalised support

· Testimonials or feedback where you have separately agreed to their use

Under POPIA, health information is special personal information.

Under GDPR, health information is special-category personal data and receives additional protection.

30. WHY DO I COLLECT AND USE YOUR INFORMATION?

· I may use your information to:
Provide your sessions and programmes

· Understand your individual needs

· Prepare personalised therapeutic recordings

· Arrange and manage appointments

· Communicate with you

· Process payments

· Maintain appropriate professional records

· Provide follow-up support

· Comply with legal, regulatory and insurance requirements

· Protect the safety and rights of clients and others

· Respond to lawful requests from authorities

I will only collect and use information that is reasonably necessary for these purposes.

31. LEGAL BASIS FOR PROCESSING

Where GDPR applies, I will process ordinary personal data on an appropriate lawful basis under Article 6 GDPR.

Where I process health information or other special-category data, I will also rely on an applicable Article 9 condition.

Where explicit consent is required for processing your health information, I will obtain that consent separately and clearly.

You may withdraw consent where consent is the legal basis for processing. Withdrawal does not affect processing that was lawfully carried out before consent was withdrawn.

Under POPIA, personal information will be processed in accordance with the applicable conditions for lawful processing, including purpose limitation, minimality, openness, security safeguards and data-subject participation.

32. CONSENT TO HEALTH INFORMATION

Where your health or mental-health information is collected for the purpose of providing therapeutic services, you acknowledge that this information may be necessary for me to understand your circumstances and provide appropriate services.

Where applicable law requires explicit consent for processing such information, your consent will be obtained separately or through the client consent process.

You may withdraw consent where legally permitted, although this may affect my ability to continue providing services where the information is necessary for the service.

33. WHO MAY RECEIVE YOUR INFORMATION?

I do not sell your personal information.

· Where reasonably necessary, information may be processed by trusted service providers that support my business, including:
Appointment-booking providers

· Payment providers

· Email providers

· Video-conferencing providers

· Website and hosting providers

· Cloud-storage providers

· Professional advisers

· Insurers

· Courts, regulators, law-enforcement authorities or other bodies where legally required or permitted

I will take reasonable steps to ensure that appropriate privacy and security arrangements are in place with relevant service providers.

34. INTERNATIONAL DATA TRANSFERS

Because LEELTHERAPY operates internationally and uses online service providers, your personal information may be processed or stored in countries outside your country of residence.

Where GDPR applies, appropriate safeguards will be used for international transfers where required by law.

Where POPIA applies, cross-border transfers will be conducted in accordance with applicable POPIA requirements.

These safeguards may include an adequacy decision, contractual safeguards, consent or another lawful transfer mechanism recognised under applicable legislation.

35. HOW I PROTECT YOUR INFORMATION

· I take reasonable technical and organisational measures to protect your personal information against:
Unauthorised access

· Loss

· Misuse

· Alteration

· Unauthorised disclosure

No electronic storage or transmission system can be guaranteed to be completely secure.

Where a data-security incident occurs that requires notification under applicable law, I will take the required steps to notify the appropriate authority and/or affected individuals.

36. HOW LONG DO I KEEP YOUR INFORMATION?

· I keep personal information only for as long as reasonably necessary for the purposes for which it was collected, taking into account:
Professional requirements

· Legal requirements

· Accounting requirements

· Insurance requirements

· Dispute resolution

· Legitimate business requirements

Different types of information may therefore be retained for different periods.

When information is no longer required, it will be securely deleted or destroyed where reasonably possible.

37. YOUR DATA PROTECTION RIGHTS

· Depending on where you live and which law applies, you may have the right to:
Request access to your personal information

· Ask for inaccurate information to be corrected

· Request deletion of your information

· Request restriction of processing

· Object to certain processing

· Request data portability

· Withdraw consent where processing is based on consent

· Lodge a complaint with the relevant data-protection authority

These rights are subject to applicable legal exceptions.

38. SOUTH AFRICA — POPIA

· Where POPIA applies, you may have rights including the right to:
Request access to your personal information

· Request correction or deletion of personal information that is inaccurate, excessive, outdated or unlawfully obtained, where applicable

· Object to certain processing

· Object to direct marketing

· Withdraw consent where processing is based on consent

· Lodge a complaint with the Information Regulator of South Africa

LEELTHERAPY will process personal information in accordance with POPIA's requirements concerning lawful processing, purpose specification, further processing limitation, information quality, openness, security safeguards and data-subject participation.

39. EUROPEAN UNION — GDPR

· Where GDPR applies, you may have additional rights including:
Access to your personal data

· Rectification

· Erasure

· Restriction of processing

· Objection to processing

· Data portability

· Withdrawal of consent

· The right to lodge a complaint with your relevant supervisory authority

Where required, LEELTHERAPY will provide information about the legal basis for processing and the applicable safeguards for international transfers.

40. UNITED KINGDOM

Where UK data-protection legislation applies, your applicable rights under the UK GDPR and Data Protection Act 2018 will be respected.

You may have rights including access, rectification, erasure, restriction, objection, data portability and withdrawal of consent where applicable.

You may also have the right to complain to the Information Commissioner's Office (ICO).

41. CANADA — PIPEDA

Where the Personal Information Protection and Electronic Documents Act (PIPEDA), or applicable substantially similar provincial privacy legislation, applies to you, you may have rights including the right to: access your personal information; challenge its accuracy and completeness and have it amended; withdraw consent, subject to legal or contractual restrictions and reasonable notice; and lodge a complaint with the Office of the Privacy Commissioner of Canada or the relevant provincial privacy regulator.

LEELTHERAPY collects, uses and discloses personal information only with your knowledge and consent, except where otherwise permitted or required by law.

42. UNITED STATES

Where US privacy laws apply, LEELTHERAPY will respect the privacy rights applicable to you under the relevant federal and state laws, which may include, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) and comparable laws in other states.

Because US privacy requirements differ between states, your specific rights may depend on your state of residence and the circumstances in which your information is processed. Where applicable state law grants them, these rights may include the right to know what personal information is collected, the right to access and delete that information, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information and of certain targeted advertising.

Nothing in this Privacy Notice is intended to remove rights granted to you by applicable US federal or state law.

LEELTHERAPY does not sell or share personal information for cross-context behavioural advertising.

44. MARKETING

Your therapeutic information will not be used for marketing purposes without an appropriate legal basis and, where required, your consent.

You may unsubscribe from marketing communications at any time.

Your agreement to receive therapeutic services is separate from your agreement to receive marketing communications.

CLIENT TESTIMONIAL & FEEDBACK CONSENT

45. YOUR FEEDBACK

Providing feedback is entirely voluntary.

Choosing not to provide feedback will not affect your relationship, treatment or services with LEELTHERAPY.

If you provide a testimonial, I will ask for your separate permission before using it for marketing.

46. HOW YOUR TESTIMONIAL MAY BE USED

· With your explicit consent, your testimonial may be used on:
The LEELTHERAPY website

· Social media

· Brochures

· Presentations

· Other LEELTHERAPY marketing materials

You may choose how you are identified:
☐ Anonymous

☐ First name and last initial

☐ Full name

I will not publish your testimonial in a way that identifies you beyond the level to which you have expressly consented.

Where your testimonial contains information about your health, therapy or personal circumstances, your consent to publication will be treated as separate and explicit consent.

47. WITHDRAWING TESTIMONIAL CONSENT

You may withdraw your consent to future use of your testimonial at any time by contacting LEELTHERAPY.

Following your request, I will stop using the testimonial in new marketing materials, subject to reasonable limitations regarding materials that have already been printed, distributed or published by third parties.

☐ I understand that I remain responsible for seeking appropriate medical or mental-health care where necessary.

☐ I understand the 48-hour cancellation and payment terms.

☐ I have read and understood the Privacy Notice.

☐ Where applicable, I explicitly consent to LEELTHERAPY processing my health information for the purpose of providing the agreed therapeutic services.

☐ I confirm that I am at least 18 years of age (or the age of majority in my jurisdiction), or that a parent/legal guardian is providing consent on my behalf where locally permitted.

☐ I have read and accept the Limitation of Liability, Indemnification, Assumption of Risk and Governing Law & Dispute Resolution sections of these Terms.

☐ I consent to accepting these Terms and related documents electronically, and understand this has the same legal effect as a handwritten signature.
